considering legislation to expand no smoking policies in the city. land reports may be forces to tell renters if their new neighbors are smokers. if the measure is approved. building with 50 or fewer units will have until december of next year to designate smoking or nonsmoking. the board will vote next year on measure that bans smoking at street fairs and other outdoor events on city owned property. >>> sonoma and concord debating issues on growing marijuana for medicinal use. the board will consider a plan to limit medical marijuana patients to having six mature plants and eight ounces of dry pot, per year, the same as the state law. sonoma allows 30 plants and three pounds of dried pot in concord hearing to decide whether patients should continue to be allowed to grow marijuana outdoors or move towards banning it city wide. >>> recreational marijuana use is legal in colorado. governor signed the bill into law yesterday even though he does not endorse it. he said he didn't want to block the will of the voters. medical marijuana was already legal in colorado, now people can legally u

bit better returns here up from south san francisco, daly city, san bruno. pretty quiet in the south bay except for morgan hill and gilroy some shower activity. winds gusting to 49 miles an hour at sfo. a wind warning in effect. and oakland, 36 miles an hour. you can see all across the bay area, santa rosa from 41 miles an hour to san jose. we have the wind, we have the rain, we have a flash flood watch through the evening hours. so the heaviest rain will continue to sink to the south of us throughout the morning hours and the wind advisory is up through noon today. we are looking at south winds anywhere from 20 to 30 miles an hour and we are seeing the gusts already up to 50 miles an hour. so here we are on track to see the heaviest rain from the north bay into the central bay within the next hour. so stay with us. we will keep you updated. carolyn. >> thank you, lisa. with all that going on and this series of storms the rivers are rising throughout the bay area. there's a flat warning this morning for the napa river. that's where abc7 news reporter kera clapper joins us live. how i

are investigating that city's latest homicide. police found a man shot in the middle of a residential street in east oakland yet. this was the scene from sky7hd. it happened at 83rd avenue and "e" street east of the coliseum. they closed off the block for several hours. no word on motive or possible suspects. >> cabinet week is stakes now that susan rice is out of the running as secretary of state. new names are gaining momentum. katie marzullo is live in the newsroom to break it down for us. >> as the high stakes game of musical chairs who will make up president obama's national security team. we know not ambassador susan rice, all signs point to john kerry. he has no comment on that. many republicans say he will breeze through the nomination process but it is likely he will face tough questions about his past support for syrian president. if kerry gets the job, his senate seat becomes available. scott brown may run in the special election. ambassador rice has been embroid l briomd in controversy over the terrorist attacks in benghazi. she told nbc that is why she is stepping aside.
